Mtonauticastore.it may decide, at its own discretion, to accept or not the order sent by the customer without the latter being able to make claims or rights of any kind in the event of non-acceptance of the order. The non-acceptance of the order may occur, for example, in the event of a non-compliant Customer, of a technical error on the part of the site or of goods no longer available at the time of the order confirmation and no longer available. Payments
The goods supplied must be paid for by bank transfer in advance or by credit card or cash on delivery. In case of payment by cash on delivery, a fee of € 7.00 will be charged for the rights to pay on delivery.
Unless different conditions that must be agreed in writing with MTO, cash on delivery shipments are possible up to a maximum order of € 500.00.

Shipping and delivery
Unless otherwise agreed, shipments will be made by trusted express courier MTO. The cost of shipping is calculated automatically by the system based on the value of the goods and / or the type of goods purchased. The amount varies from € 8.50 to € 15.00 including VAT depending on the type of goods for orders whose total value is less than € 250.00

The insurance of the goods can be requested as an additional service to be paid by the customer at a cost of € 10.00.

In the hypothesis of carriage forward, MTO will not be responsible for the loss and / or damage of the goods from the time of delivery to the carrier.

Delivery to destination will be carried out in 1-3 working days, excluding changes due to force majeure. In case of delays greater than those indicated, we will notify the customer by e-mail.
Delivery, unless otherwise agreed in writing between the parties, will take place during office hours every day, except holidays, from Monday to Friday.
Shipments cannot be delivered to boxes or postal codes. The shipments will be delivered to the address of the recipient indicated by the sender, but not necessarily to the person of the indicated recipient, having the right to deliver to people who the courier can reasonably consider authorized to accept the goods (e.g. doorman, warehouse worker, receptionist, family members, etc.).

If the shipment cannot be delivered at the first attempt, the recipient will be informed by the courier of the day on which the delivery will be made again. In cases where the shipment cannot be made due to refusal of the same or due to an incorrect address or because the customer has moved in the meantime, all the costs of stocking the goods will be charged to the customer.

Shipment to smaller islands and / or remote areas will be made at a higher cost that will be communicated at the time of purchase of the goods.

Risk and Ownership
When the goods are returned carriage paid and, therefore, delivered by our trusted courier, the transport takes place under the responsibility of MTO to their destination, at the customer's address.

In the event that the goods were shipped carriage forward (i.e. the customer sends his own carrier to collect the goods at our warehouse / pick up with his own vehicle), the risk is to be considered borne by the customer from the time of collection of the goods.

Regardless of the shipping method, at the time of delivery of the goods, the customer must check the integrity of the packages and the quantitative and qualitative correspondence with what is indicated in the accompanying document or invoice. Any hidden anomalies must be reported in writing, by fax or registered A / R, within 10 days of receipt of the goods. Any report beyond the aforementioned terms will not be taken into consideration. For each declaration, the customer assumes full responsibility for what is declared.

Attention : if you accept the goods, without making the necessary reservations, you will not be able in any way to claim any shortages or damage due to transport to the MTO at a later time, but exclusively to the courier.

Guarantees
All goods sold benefit from the guarantee provided by MTO and any authorized service centers. The warranty period is 1 year for sales to companies and 2 years for private use (unless otherwise indicated on specific products).

Right of withdrawal

The Customer has the right to withdraw from the Purchase Agreement for any reason and without the need to provide explanations, subject to compliance with the procedures indicated below. To exercise the right of withdrawal, the Customer must send the request for withdrawal by registered letter with return receipt addressed to the registered office no later than 14 working days from the date of receipt of the products. The return must be made by the Customer, through the shipment of the products covered by the withdrawal, by courier of his choice or requested to MTONauticaStore who will send a courier for collection directly by the Customer, then charging the costs of separation.

The right of withdrawal, as specified in art. 59 of the Consumer Code, is not feasible for the supply of customized or tailor-made goods.
For the purposes of the valid exercise of the aforementioned right of withdrawal, the Customer must comply with the following conditions and methods:
- the withdrawal may also be applied limitedly to individual products forming the subject of a single Purchase Agreement, it being understood that the withdrawal applies to the product in its entirety;
- the products forming the subject of Purchase Agreements in relation to which the Customer has exercised the right of withdrawal must be intact and will be returned in the original packaging, complete in all its parts (including packaging and any ancillary documentation ); in particular, if the products consist of audiovisual products or magazines, the packaging seals and / or SIAE marks must not be broken or removed;

Once the integrity of the returned product has been verified, MTONauticaStore will refund the Customer the amount paid for the product, excluding the management costs of sending the order (packaging, transport, cash on delivery, etc.) and shipments for possible return for the products referred to in the Purchase Agreement subject to withdrawal, no later than 14 days from the return of the products themselves.
The refund will be made by transferring or crediting the amount charged to the credit card indicated by the consumer customer or by bank transfer, in accordance with the related instructions and bank details that will be indicated by the same customer.
If the returned product is damaged, MtoNauticaStore will immediately notify the Customer of the incident in order to allow him to promptly file a complaint against the courier he has chosen, against which (and / or the relative insurance company) to claim;
MtoNauticaStore is not responsible in any way for damage or theft or loss of products returned by the Customer by sending goods with his courier; any related risk therefore remains the sole responsibility of the Customer.

In any case of non-compliance with the conditions and methods of exercising the withdrawal provided and indicated above in the paragraph "Right of withdrawal" which precedes the case of damage to the products for reasons other than their transport, the Purchase Agreement will remain valid and effective and MTONauticaStore will return the unduly returned products to the sender Customer, charging the related shipping costs to the same. In case of purchase with free shipping, the shipping costs equal to the cost of returning the goods will also be charged.
